These guidelines are intended to assist law enforcement officials in understanding the types of data ONLYHUGS HOLDING LLC (“OnlyHugs”) may have available and the procedures for requesting such data. These guidelines do not create any enforceable rights against OnlyHugs and are subject to change.

1. Overview of OnlyHugs

OnlyHugs is an online dating platform operated by ONLYHUGS HOLDING LLC, a Delaware limited liability company. The platform allows registered users to create profiles, upload photos, and interact with other users for the purpose of forming personal connections.

2. Types of Data Available

Depending on the nature of the account and activity, OnlyHugs may have the following categories of data:

2.1. Subscriber Information

• Name (as provided by the user).
• Email address.
• Phone number (if provided for verification).
• Date of birth (as provided by the user).
• Account creation date.
• Profile information (gender, bio, preferences).
• Profile photos.

2.2. Transactional / Billing Records

• Payment method type (e.g., credit card, but not full card numbers).
• Transaction dates and amounts.
• Subscription type and status.
• Billing address (if provided).

2.3. Activity and Log Data

• IP addresses and timestamps of login activity.
• Device identifiers and operating system information.
• Approximate geolocation data (based on IP address or device settings).
• Account activity logs (profile views, likes, matches).

3. Data Retention

OnlyHugs retains user data for the period necessary to fulfill the purposes described in our Privacy Policy. After account deletion, certain data may be retained for a limited period as required by law, for fraud prevention, or to comply with legal obligations.

4. Legal Process Required

OnlyHugs complies with valid legal process issued in accordance with applicable law. The type of legal process required depends on the type of data requested:

4.1. Subpoena (Grand Jury or Administrative)

A valid subpoena is required for basic subscriber information and transactional records.

4.2. Court Order (18 U.S.C. § 2703(d))

A court order under 18 U.S.C. § 2703(d) or equivalent is required for activity logs, IP addresses, and other non-content records.

4.3. Search Warrant

A search warrant issued upon a showing of probable cause is required for the content of communications (e.g., private messages).

4.4. Emergency Disclosure Requests

In accordance with 18 U.S.C. § 2702(b)(8) and § 2702(c)(4), OnlyHugs may voluntarily disclose user data to law enforcement without legal process if we believe in good faith that an emergency involving danger of death or serious physical injury to any person requires disclosure of the information without delay.

5. How to Submit Requests

All law enforcement requests must be submitted in writing and should include:

• The requesting officer's name, badge number, and agency.
• A valid email address for the requesting officer.
• The specific data requested.
• The legal basis for the request (subpoena, court order, search warrant, or emergency).
• Identifying information for the account(s) at issue (email address, username, or profile URL).

OnlyHugs will honor valid preservation requests issued by law enforcement in accordance with 18 U.S.C. § 2703(f). We will preserve the relevant account data for 90 days, renewable upon request. Preservation requests must be submitted in writing and should specify the account(s) at issue and the type of data to be preserved.

7. International Requests

Law enforcement requests from outside the United States must be submitted through a Mutual Legal Assistance Treaty (MLAT) request or other appropriate diplomatic or legal channel, unless the request qualifies for voluntary disclosure under an emergency exception.

8. User Notification

OnlyHugs may notify users of law enforcement requests for their data unless legally prohibited (e.g., by a court-issued non-disclosure order under 18 U.S.C. § 2705(b)) or where notification would jeopardize an ongoing investigation or endanger the safety of any person.

9. Child Safety

OnlyHugs is committed to child safety and cooperates fully with law enforcement in investigations involving the exploitation of minors. In accordance with federal law (18 U.S.C. § 2258A), OnlyHugs reports apparent child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC).

Requests for witness testimony or expert analysis must be submitted through proper legal channels. OnlyHugs may require adequate advance notice and compensation for employee time, as permitted by law.
